THE HON'BLE SRI JUSTICE T.SUNIL CHOWDARY SECOND APPEALS No.511 and 581 of 1998 COMMON JUDGMENT:

S.A.No.511 of 1998:

This appeal is filed by the defendants, under section 100 CPC, assailing the judgment and decree dated 09.02.1998 in A.S.No.51 of 1991 on the file of Senior Civil Judge, Amalapuram, wherein whereby the decree and judgment dated 25.03.1991 in O.S.No.309 of 1982 on the file of Principal District Munsif Court, Amalapuram, decreeing the suit filed by the plaintiffs in part, was confirmed.

S.A.No.581 of 1998:

This appeal is filed by the defendants, under section 100 CPC, assailing the judgment and decree dated 09.02.1998 in A.S.No.50 of 1991 on the file of Senior Civil Judge, Amalapuram, wherein whereby the decree and judgment dated 25.03.1991 in O.S.No.153 of 1981 on the file of Principal District Munsif Court, Amalapuram, decreeing the suit filed by the plaintiffs in part, was confirmed.

At the time of hearing, learned counsel for the appellants submitted that the appellants in both the appeals are common. He further submitted that the respondents-plaintiffs sold the property to third parties during pendency of the litigation. He further submitted that in view of changed circumstances, no further orders are necessary in these appeals.

In view of the submission made by the learned counsel for the appellants, no further orders are necessary in these two

appeals and the second appeals are accordingly closed. There shall be no order as to costs. As a sequel, miscellaneous petitions pending, if any, shall stand closed.
