This writ petition is filed seeking to declare the action of the 3rd respondent in calling the petitioners to the Police Station Shamirpet, Cyberabad, without there being a case or crime registered against the petitioners, as being illegal and arbitrary.

Heard the learned counsel for the petitioners and the learned Assistant Government Pleader for Home.

Learned Assistant Government Pleader for Home, on written instructions, dated 07.01.2020, submits that, the 4th respondent in the present writ petition lodged a complaint before the 3rd respondent, on 28.11.2019, wherein it is stated that the complainant's mother had land in Survey No.464 admeasuring 20 guntas and Survey No.463 admeasuring 171⁄2 guntas situated at Bourampet Vilalge and civil disputes are pending regarding the said land. It is further stated that one Arun Kumar and others got registered the land without paying total consideration to the complainant's mother and when contacted, the said persons are abusing the 4th respondent and threatening with dire consequences, as such, requested the 3rd respondent to take action. It is also submitted that on receipt of the above complaint, the 3rd respondent made an entry in the General Diary and for the purpose of enquiry, called both the parties to the police station. However, the first petitioner did not attend for enquiry. 4.

While denying the allegations in the writ petition with regard to the petitioners being called to the police station on 15.12.2019 and 24.12.2019 and also the constable of the 3rd respondent visiting the

petitioners' house, it is stated that except calling the petitioners to enquire into the complaint lodged by the 4th respondent, the 3rd respondent never interfered in the civil disputes. The 1st petitioner, instead of cooperating with the Investigating Officer, has approached this Court by making false allegation is the submission of the learned AGP. Copies of the said written instructions and the complaint are placed on record of this Court. 5.

Having regard to the submissions made by the learned Assistant Government Pleader on behalf of the official respondents, no further orders need be passed in the present writ petition. 6.

The writ petition is accordingly closed. Pending miscellaneous petitions, if any, shall also stand closed in the light of this final order. No order as to costs.
