HON'BLE THE CHIEF JUSTICE SRI THOTTATHIL B. RADHAKRISHNAN AND HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.1895 OF 2019 ORDER: (ORAL) (Per the Hon'ble the Chief Justice Sri Thottathil B.Radhakrishnan) This matter relates to issuance of a notification for conducting elections to Gram Panchayats. Those elections are over. Therefore, that issue does not survive. Hence, grievance of the petitioner is regarding classification of areas of two Gram Panchayats.

2. Learned Government Pleader points out that similar issue arose for decision in W.P (PIL).No.171 of 2018 and this Court noticed that the matter is entirely within the legislative domain and not even for the Government to take a final decision.

3. Hearing the learned counsel for the petitioner and the learned Government Pleader, we are satisfied that the same procedure adopted in W.P (PIL).No.171 of 2018 can be followed in the case in hand.

4. Accordingly, there will be a direction that if the petitioner has made an appropriate representation or if he makes such a representation with relevant facts and materials to the satisfaction of the competent authority, the authority will bestow due attention to that representation and consider it in accordance with law. If the Government sees any ex facie injustice in the situation now obtained, that may be appropriately brought to the notice of the competent legislature.

5. The Writ Petition is ordered accordingly. No order as to costs. The Miscellaneous Petitions, if any pending, in the writ petition stand closed.
