THE HON'BLE SRI JUSTICE M.S.RAMACHANDRA RAO WRIT PETITION NO.37937 OF 2016 ORDER:
Petitioner has filed the Writ Petition to declare the action of respondents in not considering the notional promotion to the post of ADE and further promotion of Divisional Engineer on par with his juniors.
It is not in dispute that the petitioner was originally convicted of an offence involving moral turpitude and dismissed from service but later Crl.A.No.1875 of 2005 was allowed and he was reinstated. Thereafter, proceedings dated 20.05.2016 were issued regularizing the suspension period and interregnum period between dismissal and reinstatement into service.
Counsel for petitioner contends that the petitioner ought to have been considered for notional promotion as ADE and further promotion as Divisional Engineer and though he has submitted a representation on 01.06.2016 to first respondent, no action has been taken thereof.
Sri R.Vinod Reddy, learned Standing Counsel for respondents 1 and 2, states that the first respondent will consider the petitioner's representation dated 01.06.2016 within six weeks from the date of receipt of a copy of this order and communicate decision thereon to the petitioner.
The Writ Petition is disposed of directing the first respondent to consider the petitioner's representation dated 01.06.2016 within six
(6) weeks from the date of receipt of a copy of this order and communicate decision thereon to the petitioner. There shall be no order as to costs. Miscellaneous petitions, if any, pending shall stand closed.
