THE HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.18859 OF 2017 ORDER:

This Writ Petition, under Article 226 of the Constitution of India, is filed seeking to declare the action of the respondents 2 and 3 in issuing notice, dated 21.06.2013 vide No.5-3-510/ 557/ ACP/ TPS/ C8/ GHMC/ 2012, under Section 459 of the Hyderabad Municipal Corporation Act, 1955 in respect of Mulgies bearing Nos.5-3-516, 5-3-552, 5-3-555 & 5-3-557 situated at Topkhana Road, Osman Gunj, Hyderabad, as ilelgal and arbitrary.

Heard and perused the material available on record. This Court perused the impugned notice. In the said notice it is clearly stated that if the petitioners have any objections, they are entitled to make a representation and adduce evidence if any. Therefore, without expressing any opinion on merits, this Court is inclined to pass the following order:

" The petitioners are directed to submit their representations setting out their objections, if any, within a period of fifteen (15) days from the date of receipt of a copy of this order to the 2nd respondent, and on receipt of such representations, the 2nd respondent shall consider the same and pass appropriate orders in accordance with law. Till such time, the respondents are directed not to proceed with the demolition of the structures of the petitioners.

With the above direction, the Writ Petition is disposed of. Miscellaneous petitions pending in this Writ Petition, if any, shall stand closed. There shall be no order as to costs.
