HON'BLE SRI JUSTICE P.NAVEEN RAO ORDER:

This writ petition is filed questioning the action of the respondents herein, more particularly the 3rd respondent herein, in disposing of the application of the petitioner, dated 09.02.2015, within stipulated time required under the Municipal Corporation Act or Municipality Act, as illegal.

2. Heard the learned counsel for petitioner and Smt. Pingali Lakshmi, learned Standing Counsel for the Greater Hyderabad Municipal Corporation for the 3rd respondent and with their consent the writ petition is taken up for disposal at the stage of admission.

3. The petitioner claims to be the owner and possessor of house plot admeasuring 313.3 square yards in Survey No.11 of Lashkar Singaram Village, Hanamkonda Mandal, Warangal District, and registered under Sale Deed bearing Document No.1059 of 2010, dated 11.02.2010. The petitioner states to have submitted a representation to the Commissioner, Municipal Corporation, Greater Warangal, Warangal District (3rd respondent), dated 09.02.2015, for granting permission for construction of the petitioner's own residential house over the subject house plot, but so far, no orders are passed. Hence, this writ petition.

4. When the matter is taken up, both counsel agreed for disposal of the writ petition with a direction to the 3rd respondent to expeditiously dispose of the representation of the petitioner, dated 09.02.2015.

5. Having regard to the same, without expressing any opinion on the merits of the matter, the Writ Petition is disposed of directing the Commissioner, Municipal Corporation, Greater Warangal, Warangal District (3rd respondent), to consider the representation of the petitioner, dated 09.02.2015, pass appropriate orders, as warranted under law, within a period of two (2) weeks from the date of receipt of a copy of this order and communicate the decision to the petitioner. There shall be no order as to costs.
