This Criminal Petition is filed under Section 438 of Code of Criminal Procedure (for short 'Cr.P.C.') by the petitioner/Accused No.4 seeking bail in the event of his arrest in connection with Crime No.6 of 2024 on the file of Patancheru Police Station, Sangareddy, registered for the offence under Sections 5 & 6 of Explosive Substances Act, 1908.

Heard learned counsel for the petitioner and learned Additional Public Prosecutor for respondent-State.
Perused the record.

The Police Patacheru, registered a crime on 02.01.2024 having found the explosive substances in possession of Nos.1 to 3, who were workers in Sri Vensai Metals Quarry Plant. Accused No.5 was running business in the name of Durgabai Enterprises and sold the above explosive material to accused No.6 and two others for profit. The petitioner herein is one of
the partner in PMR Crushers along with A-7 wherein they appointed A-1 as site in-charge of their Unit. 4.
Learned counsel appearing for the petitioner would submit that petitioner is falsely implicated in the case and he is not aware of the illegal activities carried out by A-1 and other accused. In the remand report of other accused, this petitioner is shown as A-4.

In the said circumstances, since the petitioner was shown as partner and no specific overt acts are attributed against him, this Court deems it appropriate to grant the relief of anticipatory bail, subject to following conditions:-
1) The petitioner/Accused No.4 is directed to surrender before Station House Officer, Patancheru Police Station, Sangareddy, on or before 17.01.2024. Upon such surrender, the said Station House Officer shall release the petitioner/Accused No.7 on bail, on his executing personal bond for a sum of Rs.25,000/- (Rupees Twenty Five Thousand only) with two sureties, for a like sum each to his satisfaction.
2) On such release, the petitioner/Accused No.4 shall appear before the concerned Station House Officer
at 10:00 a.m. every day for a period of four weeks and thereafter as and when required, for the purpose of investigation.
3) The petitioner/Accused No.4 shall abide by the other conditions stipulated in Section 438(2) of Cr.P.C and shall co-operate with the Investigating Officer in investigating the case.

Accordingly, Criminal Petition is allowed.
Miscellaneous applications, if any pending in this criminal petition, shall stand closed.
