THE HON'BLE SRI JUSTICE RAJA ELANGO CRIMINAL REVISION CASE No.3202 OF 2015 ORDER:
The present criminal revision case is filed by the petitioner challenging the order, dated 30.10.2015, passed in Criminal Appeal No.92 of 2012 by the Court of the I Additional Sessions Judge, Vizianagaram, whereby the Court below dismissed the appeal filed against the order dated 11.06.2012 passed in C.C.No.165 of 2012 by the Judicial Magistrate of First Class, Special Mobile Court, Vizianagaram, acquitting the accused therein, for the offence under Section 138 of the Negotiable Instruments Act, for want of jurisdiction.
Heard and perused the records.
This Court is of the view that the present criminal revision case is not maintainable. The petitioner has the remedy of preferring the Appeal before this Court with Special Leave under Section 378(4) of the Code of Criminal Procedure. Hence, the criminal revision case is disposed of with a direction to the petitioner herein to file Criminal Appeal, is he so chooses. The Registry is directed to return the Original documents filed along with the present criminal revision case to the petitioner herein. With the above directions, the Criminal Revision Case is disposed of.
