2019-06-12Sanjay Kumar1 pages

HONOURABLE SRI JUSTI CE SANJAY KUMAR WRI T PETI TI ON Nos.288, 308 and 413 of 2018 COMMON ORDER:

The petitioners in these three cases share a common grievance. Their complaint is that the Tahsildar, Mancherial Mandal, Mancherial District, is not taking action for carrying out mutation in their favour in relation to the lands claimed by them in Sy.No.345(a) of Mancherial Village, despite their having submitted applications in the prescribed format. Perusal of the record reflects that all the three petitioners submitted their applications in Form VI (A) seeking mutation in their favour, as required by Section 4 of the Telangana Rights in Land and Pattadar Pass Books Act, 1971, read with Rule 18 of the Telangana Rights in Land and Pattadar Pass Books Rules, 1989.

It is not open to the Tahsildar, Mancherial Mandal, to remain somnolent upon receipt of such applications filed by the petitioners in the proper format. The Writ Petition is accordingly disposed of directing the Tahsildar, Mancherial Mandal, Mancherial District, to take appropriate action upon the petitioners' applications filed in Form VI (A) expeditiously and in any event, not later than four weeks from the date of receipt of a copy of this order, be it from whatever source.

Miscellaneous Petitions pending in these Writ Petitions shall stand closed in the light of this final order. No order as to costs. ____________________ JUSTI CE SANJAY KUMAR Date: 12th June, 2019.
