THE HON'BLE JUSTICE G.SRI DEVI Tr.Crl.P.No.3 of 2019 ORDER:

This Petition under Section 407 of Cr.P.C., is filed by the petitioner/accused seeking to withdraw C.C.No.306 of 2015 pending on the file of the XVIII Additional Chief Metropolitan Magistrate, Secunderabad and transfer the same to any other Court having jurisdiction of Sanathnagar Police Station.

During the course of hearing, learned counsel for petitioner and learned counsel for the 2nd respondent submit that the petitioner and the 2nd respondent are residing at S.R.Nagar and the nearest jurisdiction to dispose of the aforesaid case is on the file of III Additional Chief Metropolitan Magistrate, Erramanzil, Hyderabad, and they requested to withdraw and transfer the said case from the file of XVIII Additional Chief Metropolitan Magistrate, Secunderabad to the file of III Additional Chief Metropolitan Magistrate, Erramanzil, Hyderabad.

In the light of the prayer made by both the learned counsel with the consent of their respective parties and since the C.C., is of the year 2015, C.C.No.306 of 2015 pending on the file of the XVIII Additional Chief Metropolitan Magistrate, Secunderabad, is withdrawn and transferred to the file of III Additional Chief Metropolitan Magistrate, Erramanzil, Hyderabad; and after the case is transferred, the learned III Additional Chief Metropolitan Magistrate, Erramanzil, Hyderabad, is directed to dispose of the said C.C., in accordance with law as expeditiously as possible, preferably within a period of six months thereafter, after giving due

GSD, J Tr.Crl.P.No.3 of 2019 opportunity to the respective parties without giving unnecessary adjournments.

With the above direction, the Transfer Criminal Petition is disposed of.

Miscellaneous petitions, if any pending in this criminal petition, shall stand closed.
