Heard.
The grievance of the petitioner is that his vehicle Passion Plus bearing No.AP-29-BC-8641 was seized by the Excise Police Chandur on the allegation that he committed an offence under Section 7(a) read with 8(c) of the A.P. Prohibition Act, 1995 and a case in Cr.No.86 of 2014-15 was registered on the file of Chandur Police Station. The present writ petition is filed alleging inaction on the part of the 2nd respondent in considering and passing appropriate orders on the application filed by the petitioner on 19-06-2014 seeking release of the vehicle.
On instructions, learned Government Pleader submits that the petitioner's aforesaid application said to have been filed on 1906-2014 is not traceable in the records of the 2nd respondent and in all such cases where release of vehicles is sought, appropriate orders are being passed immediately without keeping them pending. But, however, since the petitioner's application is not traceable, no orders could be passed.
In the circumstances, I deem it appropriate to permit the petitioner to make a fresh application before the 2nd respondent seeking release of the vehicle and upon filing such application, the 2nd respondent is directed to consider the same and pass appropriate orders thereon within a week from the date of receipt of such application, keeping in view the fact that the petitioner's vehicle is under seizure for the last more than six months. Accordingly, the writ petition is disposed of. No order as to costs.
The miscellaneous petitions, if any, pending in this writ petition shall stand closed.
