THE HON'BLE THE CHIEF JUSTICE SRI KALYAN JYOTI SENGUPTA AND THE HON'BLE SRI JUSTICE SANJAY KUMAR WRIT PETITION No.12598 of 2015 ORDER: (per the Hon'ble The Chief Justice Sri Kalyan Jyoti Sengupta) This Writ Petition has been filed seeking Habeas Corpus in respect of the private detention, and indeed, prayer made by the petitioner for entertaining the Writ Petition is of police inaction.

We notice from the body of the petition and the document that on the complaint of the petitioner, First Information Report No.765 of 2014 was registered by the police, under Sections 448, 365, 506 read with 34 of Indian Penal Code. It is the allegation of the petitioner, in spite of registering aforesaid First Information Report, nothing has been done by the police. Therefore, in our view, it is a clear case of police inaction. The writ of Habeas Corpus is not appropriate remedy. It would be open for the petitioner to approach appropriate forum alleging police inaction on the given facts.

Therefore, we close this Writ Petition.

Consequently, miscellaneous petitions, if any pending, shall stand closed. No order as to costs.
