JUDGMENT:- (per Hon'ble Sri Justice G. Chandraiah) The appellant-husband filed F.C.O.P. No. 1304 of 2011 under Section 13(ia)(ib) of the Hindu Marriage Act for grant of decree of divorce against the respondent-wife, and the learned Judge, Family Court-cum-Additional District & Sessions Judge, Visakhapatnam, by order dated 10.04.2015, dismissed the petition. Challenging that order, the appellant has preferred the present Family Court Appeal.

When the matter is taken up for hearing, Sri Ravikiran Swamy Bojanapally, learned counsel for the appellant, has filed a Memo dated 11.02.2016 seeking permission of this Court to withdraw the appeal.

Permission is accorded.

Hence, the Family Court Appeal is dismissed as having been withdrawn. However, this order does not preclude the appellant from taking appropriate action in accordance with law. No order as to costs.

As a sequel to the dismissal of the Family Court Appeal, Miscellaneous Petitions, if any pending, shall stand disposed of as infructuous.
