HON'BLE SRI JUSTICE S.V. BHATT WRIT PETITION No.28410 of 2009 ORDER :
The petitioners pray for Mandamus declaring the action of 1st respondent in accepting the tender of 3rd respondent and opening the price bid of 3rd respondent in Tender Notification No.01/2009/10, dated 28.08.2009, as arbitrary and illegal.
Petitioners prayed for stay of all further proceedings in Tender Notification No.01/2009/10, dated 28.08.2009. This Court on 29.12.2009, ordered as follows : "In the meanwhile, the respondents are directed to finalise the bids pursuant to the tender notification dated 28.8.2009. But as it causes inconvenience, the respondents are hereby permitted to entrust the job of transformer repairs to any contractor on nomination basis." Having regard to the interim order, namely, enabling the respondents to entrust the work on nomination basis of repairing the defunct transformers, I am of the view that the cause in the writ petition does not survive. Writ petition is dismissed. No order as to costs. As a sequel, pending miscellaneous applications, if any, shall stand closed.
