Learned counsel for respondent No.3 in C.R.P.No.55 of 2025 produced a copy of transaction confirmation showing payment of Rs.25,00,000/- in favour of the revision petitioners.

Learned counsel for respondent No.3 submitted that the total amount involved is Rs.5,00,00,000/- in that only 5% of the amount i.e., Rs.25,00,000/- has been transferred two (02) months ago. Ever since there is no progress. By obtaining stay in this CRP, since 2024 there is no progress in the suit, the defendants therein are not filing written statement and are also not cooperating in the disposal of I.A.s filed to restrain the revision petitioners from alienating the suit schedule property and are making further construction.

In response, learned counsel for revision petitioners submitted that the amount involved in this case is only Rs.3,00,00,000/- and not Rs.5,00,00,000/- as claimed by the learned counsel for respondent No.3.

Respondent No.3 intends to settle the matter once for all by paying the total amount within one (01) month as per the Memorandum of Understanding, which is

drafted but is awaiting for signatures.

Having regard to the submissions made by both the learned counsel, the matter is to be listed immediately after vacation i.e. on 23.01.2026, for reporting on payment of total amount. Failing which, the stay granted on further proceedings in the suit shall stand automatically vacated.
