It is the case of the petitioner that pursuant to his complaint, the respondents have issued a notice dated 26.3.2015 asking him to appear before the investigating officer within three days, which was served on him subsequent to the date of hearing. Thereafter, the petitioner personally approached the office of the respondent/investigating officer wherein he was not present or otherwise engaged in bandobast duty.

It is admitted by the petitioner that he has not filed any letter or representation before the respondent authorities requesting to furnish the date of hearing subsequent to the above notice and in view of the same, learned counsel for the petitioner submits that the cause of action still survives.

Therefore, the Writ Petition is dismissed. However, petitioner is at liberty to file a representation before the concerned authorities for taking appropriate legal steps available under law. Pending miscellaneous petitions, if any, shall stand dismissed. No order as to costs.
