THE HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.22567 of 2017 ORDER:
This Writ Petition is filed by the petitioners under Article 226 of the Constitution of India seeking to declare the action of the 1st and 2nd respondents in adopting coercive measures to evict the petitioners from their lands highhandedly without initiating land acquisition proceedings as illegal, arbitrary and violative of Article 300-A of the Constitution of India and to consequently direct the respondents not to interfere with the possession and enjoyment of the petitioners over their respective lands admeasuring Ac.1.00 cents in Survey No.671/52; Ac.2.00 guntas in Survey No.671/30 and Ac.1.00 guntas in Survey No.671/1 of Suryapet Village, Suryapet Mandal, Nalgonda District (present Suryapet District). 2.
When the matter is taken up for hearing, it is informed by the learned counsel for the petitioners that as far as petitioners 2 and 3 are concerned, he is not pressing the writ petition for any relief and as far as the 1st petitioner is concerned, already the 1st petitioner has availed the remedy of appeal and hence, he is not pressing the writ petition as far as the first petitioner is concerned and prays to dismiss the writ petition as not pressed. 3.
Recording the said submissions, the Writ Petition is dismissed as not pressed. There shall be no order as to costs. Miscellaneous petitions, if any, pending in this writ petition shall stand closed.
