THE HON'BLE SRI JUSTICE A. RAJASHEKER REDDY WRIT PETITION No.43822 OF 2016 ORDER:
This Writ Petition is filed to declare the action of respondent No.3 in passing order, dated 24.01.2015, suspending the fair price shop authorisation of the petitioner, as illegal and arbitrary. During the course of hearing, it is submitted by the learned counsel for petitioner that the petitioner filed an appeal before the then Joint Collector (CS) - II, Ranga Reddy Distirct, against the order, dated 24.01.2015, in Proc.No.C/50/2015, along with stay petition, but no orders are passed as on today. He also submits that neither enquiry is contemplated nor any orders are passed on the stay petition or the appeal.
Heard learned Government Pleader for Civil Supplies. In view of the facts and circumstances of the case, respondent No.2 is directed to dispose of the appeal filed by the petitioner within a period of four weeks from the date of receipt of a copy of this order. Respondent No.3 is also directed to complete the enquiry within a period of four weeks from the date of receipt of a copy of the order, if enquiry is not concluded. Till enquiry is completed, the respondents are directed to continue the petitioner as fair price shop dealer.
With the above direction, the Writ Petition is disposed of. Miscellaneous Petitions, if any, pending in this Writ Petition, shall stand closed. There shall be no order as to costs. __________________________ A. RAJASHEKER REDDY, J December 16, 2016.
