WRIT P, ETITION No.18247 of2017 I ORDER : (ORAL) (per Hon'ble Sri Justice Suresh Kumar Kait) In the present writ petition, the petitioners have assailed the order dated 18.04.2017 in M.A.No.230 of 2017 in O.A.No.148 of 2017 passed by the A.P. Administrative Tribunal, Hyd rabad (for brevity "the Tribunal"), whereby the Tribunal passed interim order as follows:

"Any further promotions made to the post of Lay Secretary and Treasurer .Gra de- II are subject to further orders in this Original Application.

Government Pleader is directed to get instructions in the O.A. as directed earlier or else to file counter within a period of three weeks.

Post on 12.06.2017."

As stated by Sri G. Vidya Sagar, learned Senior Counsel, representing Smt. K. Udaya Sri, learned counsel for the petitioners, till date, the respondents have not filed counter affidavit in the aforesaid 0.A.No.148 of 2017, thereby delaying the matter for being adjudicated by the Tribunal. 3.

Since the issue raised before this Court is the subject matter of O.A.No.148 of 2017, which is pending adjudication before the Tribunal, we are of the opinion that no interference is required by this Court in the present writ petition. However, we deem it appropriate to direct the respondents to

• SKK,J & Dr. SA,J W.P.No.18247 of2017 file counter affidavit in the said O.A. by serving an advance copy to the other side counsel before the next date of hearing i.e., 12.06.2017. Upon filing of the counter affidavit by the respondents, the petitioners are at liberty to file a rejoinder, if any, either before the next date of hearing or seek permission of the Tribunal on the next date of hearing to file a rejoinder, if they are so advised.

Keeping in view the issue raised in the present writ petition, we hereby direct the Tribunal to decide the aforesaid 0 .A. by passing appropriate orders in acc9rdance with law, after giving an opportunity of hearing to both the parties, within a period of four weeks from the date of completion of pleadings and arguments in the said O.A.

With the above direction, this writ petition is disposed of. No order as to costs.

As a sequel, miscellaneous petitions· pending, if any, shall stand closed.
