K.Rohith, S/o. Babu Rao Petitioner/Accused-1 AND State of Telangana, rep by its Public Prosecutor, High Court at Hyderabad. Respondent/Complainant Petition under Sections 437 & 439 of Cr.P.C. praying that in the circumstances stated in the grounds filed herein, the High Court may be pleased to enlarge the Petitioner/Accused No.1 on bail in Crime No. 783 of 2017 of P.S. Jubilee Hills, Hyderabad to abide by any terms and conditions for his released on bail in the interest of justice.
The Petition coming on for hearing, upon perusing the petition and the grounds filed herein and upon hearing the arguments of Sri A.Sanjeeva Reddy, Advocate for the Petitioner and of the Addl. Public Prosecutor (TG) for the Respondent, the Court made the following ORDER:
" This Criminal Petition is filed by the petitioner/A-1 under section 437 and 439 Cr.P.C., seeking grant of bail to the petitioner, who is A-1 in Crime No. 783 of 2017 of Jubilee Hills Police Station, Hyderabad District, registered for eh offences punishable under section 21(b), 22(c), 217(a) of Narcotic Drugs and Psychotropic Substances Act, 1985.
2. Heard both sides.
3. As per the case of prosecution, eight alleged L.S.D. stamps were recovered from the possession of this petitioner/A-1.
4. The counsel for the petitioner/A1 submits that the quantity of contraband in this case is no where mentioned in the remand case diary, which fact is not disputed by the learned Additional Public Prosecutor. It is also further submitted that this petitioner/A-1 is a student of Law and he has been in jail since thirty five days and his studies are at stake.
5. Hence, considering the submissions of the counsel for the petitioner and considering the fact that the quantity of ganja is not mentioned in the remand case diary, this Criminal Petition is allowed and the petitioner/A-1 is directed to be released on bail on his executing a personal bond for Rs. 20,000-00 (Rs. Twenty Thousand only) with two sureties for a like sum each to the satisfaction of XVII Additional Chief Metropolitan Magistrate, Nampally, Hyderabad. The petitioner/A-1 shall appear before the Station House Officer, Jubilee Hills Police Station, Hyderabad, on every Wednesday and Sunday between 04.00 p.m., and 05.00 p.m., until further orders.
5. As a sequel, miscellaneous petitions if any, pending in this Criminal Petition shall stand closed."
