HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No.14751 of 2016 ORDER:

This writ petition is filed for a mandamus declaring the action of the 2nd respondent in not suspending the proceedings of the 3rd respondent dated 23.09.2015 and the proceedings of the 4th respondent dated 08.04.2015 pending revision, as illegal and arbitrary.

It is the case of the petitioner that he was appointed as permanent fair price shop dealer in respect of Shop No.42, Basampalli Village of Hindupur Mandal, Anantapur District in the year 1990. On the basis of the report submitted by the 5th respondent-Tahasildar, a showcause notice was issued to the petitioner on 18.03.2015. Without considering the explanation of the petitioner, the 4th respondent issued proceedings dated 08.04.2015 cancelling the authorization of the petitioner. Aggrieved by the same, the petitioner filed appeal before the 3rd respondent and that the same was dismissed on 23.09.2015. Challenging the same, the petitioner filed W.P.No.34205 of 2015 before this Court and the same was also dismissed giving liberty to the petitioner to file a revision before the District Collector. Thereupon, he filed a revision before the 2nd respondent along with an application to suspend the proceedings dated 08.04.2015

by the 4th respondent pending consideration of the revision. The grievance of the petitioner is that the 2nd respondent, without suspending the proceedings dated 08.04.2015, simply adjourning the matter. Hence, the present writ petition.

The learned Government Pleader, on instructions, submitted that the revision filed by the petitioner has already been rejected, which the petitioner is unable to confirm or deny.

As the petitioner has already availed the opportunity of filing revision, interest of justice would be served if a direction is issued to the 2nd respondent to dispose of the revision. As on the date, if no orders are passed in the revision, the 2nd respondent is directed to dispose of the revision as expeditiously as possible.

With the above direction, the writ petition is disposed of. No costs.

Miscellaneous petitions pending, if any, shall stand closed.
