THE HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI WRIT PETITION No. 9400 OF 2010 ORDER:

This writ petition is filed seeking Writ of Certiorari calling for the records relating to E.P. No.10 of 2009 in M.P. No.13 of 2006 in I.D. No.156 of 1994, dated 11.03.2010 on the file of the 1st respondent and set aside the orders passed in E.P.No.10 of 2009 in MP No.13 of 2006 in ID No.156 of 1994, dated 11.3.2010, as illegal and arbitrary. When the matter is taken up for hearing, it is noticed that the petitioners are challenging only the orders passed in E.P.No.10 of 2009 but they have not challenged the orders passed in M.P.No.13 of 2006 and I.D.No. 156 of 1994, dated 29.6.1996 by the Labour Court -III, Hyderabad. The execution proceedings are only consequential orders. Until and unless, the petitioner challenged the orders passed in MP No.13 of 2006 and ID No.156 of 1994, this Court cannot adjudicate the issue in respect of execution proceedings. More over, the orders passed in I.D.No.156 of 1994 had been complied with reinstating the respondent No.2- workman into service. In view of the same, the consequential proceedings cannot be challenged by the petitioner.

In view of the above, the writ petition is devoid of merits. Accordingly, the writ petition is dismissed. No costs. Miscellaneous petitions pending if any, shall stand closed. ________________________________ ABHINAND KUMAR SHAVILI, J Dated: 19/09/2018 Slk
