THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No.38373 of 2012 ORDER:

This Writ Petition is filed challenging the proceedings, dated 03.12.2012 whereunder the respondents proposed to terminate the services of the petitioner from the respondent bank in exercise of the powers conferred on the first respondent under Regulation 11 of the Export-Import Bank of India Officers' Regulations, 1982 and gave an opportunity to the petitioner to submit a representation within 14 days.

This Court by order, dated 12.12.2012 while issuing notice before admission, granted interim suspension of the impugned proceedings and the said interim suspension is in operation till today.

At the hearing, learned Senior Counsel appearing for the respondents, on instructions, submits that the respondents want to withdraw the impugned proceedings as they propose to conduct regular departmental enquiry in respect of the allegations levelled against the petitioner.

ARLR, J W.P.No.38373 of 2012 Earlier, the respondents wanted to take action under Regulation 11 of the aforesaid Regulations on the ground that it was not possible or expedient to proceed against the petitioner as per the disciplinary procedure. But, now, for the reasons best known to them, the respondents want to conduct regular departmental enquiry against the petitioner as provided under the Regulations.

In view of the above, recording the statement of the learned Senior Counsel appearing for the respondents, this writ petition is closed leaving the issues open to both the parties.
