HON'BLE SRI JUSTICE VILAS V.AFZULPURKAR W.P.No.26306 of 2015 ORDER:

The petitioner sought NOC and approached the 2nd respondent by way of representation, dated 26-06-2015 stating that he is having the land admeasuring Ac.1-00 cents in Sy.No.146-25-1 situated at Peddapalem Village, Atchampeta Mandal, Guntur District, and for which, he was issued pattadar passbooks and title deeds. However, a rectification deed, which the petitioner seeks to incorporate to rectify the schedule of the land, under which the agreement of sale was executed on 30-03-2015, is not being entertained by the 4th respondent on the ground that NOC is necessary. The petitioner states that the 2nd respondent has already sent appropriate report to the Revenue Divisional Officer, Guntur on 07-07-2015 and submits that neither NOC is issued nor his rectification deed is entertained by the 4th respondent.

Learned Government Pleader states that as per the report of the 2nd respondent, the Revenue Divisional Officer is required to take appropriate decision and since the report, dated 07-07-2015, is already before the Revenue Divisional Officer, he would take appropriate action in accordance with law.

In the circumstances, I deem it appropriate to direct the 1st respondent to obtain appropriate further report from the Revenue Divisional Officer, Guntur, in pursuance of the report of the 2nd respondent, dated 07-07-2015 in Rc.No.274/2015-A and then consider and pass appropriate orders expeditiously, preferably within six weeks from the date of receipt of a copy of this order.
