HON'BLE SRI JUSTICE A. RAMALINGESWARA RAO WRIT PETITION NO. 876 OF 2017 ORDER:

This Writ Petition was filed challenging the inaction of the 2nd respondent in investigating the Crime No. 107 of 2014. 2.

Now the second respondent filed a counter affidavit stating that the skeleton of the son of the petitioner was found at 12.30 P.M on 25.6.2014 on the Gobodu hill in the forest between Konduru and Nindujerla Villages of Atchampeta Mandal, by one Gudari Veeraiah, who went there to graze his cattle. Basing on the report of the Village Revenue Officer, Konduru Village, a case in Crime No. 107/2014 was registered on 25.6.2014 under Section 174 Cr.P.C. The petitioner and his relatives identified the deceased by seeing the clothes and slippers of the deceased, which were found besides the dead body. The deceased was said to be missing from 30.4.2014 but no report was lodged.

During the course of investigation, it was revealed that the deceased was a student of intermediate in Pragathi Junior College, Sattenapalli, and used to live in the hostel of the college. While so, one Gopala Krishna, room-mate and close friend of the deceased, who was last seen with the deceased, committed suicide by consuming pesticide at his residence on the intervening night of 2/37.2014. In respect of the death of the friend of the petitioner's son, a case in Crime No. 110/2014 was registered on the file of 4th respondent and the same was closed as 'Drop further action'. In case of the petitioner's son, 17 witnesses were examined and their statements were recorded.

Medical Officer, Area Hospital, Sattenapalli to find out the final opinion, on 16.1.2017. The report from the Medical Officer, Area Hospital, Sattenapalli is awaited.

In view of the above facts, it cannot be said that the police are not investigating the case. However, in view of the pendency of the crime for the last three years, the 4th respondent is directed to complete the investigation and submit a final report/charge sheet, as expeditiously as possible, but not later than three months from the date of receipt of a copy of this order.

Accordingly, this Writ Petition is closed. There shall be no order as to costs. As a sequel thereto, miscellaneous petitions, pending if any, shall stand closed.
