HON'BLE SRI JUSTICE A. SHANKAR NARAYANA SECOND APPEAL No.61 OF 2008 JUDGMENT:

In fact, when there was no representation for the appellant on 27.06.2017, the present matter was directed to be listed under the caption 'for dismissal'.

Sri Ramachandar Rao Vemuganti, learned counsel for respondent No.1-decree holder, filed the stay vacate petition in S.A.M.P.No.1421 of 2014, who has been consistently representing for vacating the stay. But, on account of non-appearance of learned counsel for the appellant, who is respondent No.1 in the stay vacate petition, the petition could not be disposed of. Even otherwise since the second appeal itself is coming up under the caption 'for dismissal' and today also there is no representation for the appellant, the second appeal is dismissed for non-presentation.

As a sequel thereto, Miscellaneous Petitions, if any, pending in the second appeal stand closed.
