THE HONOURABLE SRI JUSTICE T.AMARNATH GOUD MACMA NO. 692 of 2011 JUDGMENT:
This appeal is filed by the insurance company aggrieved by the award and decree dated 20.12.2010 in O.P.No.83 of 2007 passed by the Motor Vehicle Accidents Claims Tribunal-cum-V Additional District Judge, FTC, Khammam at Kothagudem (for short 'the tribunal).
Learned counsel for the Insurance Company contended that that the award passed by the tribunal is contrary to the evidence available on record and that the deceased traveled as unauthorized passenger in the vehicle and hence, the insurance company is not liable to pay the compensation and prayed to allow the appeal. The tribunal after examining PW.1 and marking Exs.A1 to A.4 on behalf of the claimants and as there was no oral or documentary evidence on behalf of the respondents passed the reasoned order. Therefore, the order passed by the tribunal is well considered and needs no interference of this Court in all aspects and hence, the appeal is liable to be dismissed. In view of the above, the appeal is dismissed. There shall be no order as to costs.
