THE HON'BLE SRI JUSTICE A.V. SESHA SAI WRIT PETITION No.11025 of 2015 ORDER:

This writ petition is filed under Article 226 of the Constitution of India seeking following relief:

"to issue Writ of Mandamus declaring the action of the 2nd and 3rd respondents in not taking any action against the 4th respondent and see that the petitioner's father Major Thota Venkateshwara Rao (Retired) is discharged from the 4th respondent Home and permit the petitioner to take him to Banglore for better treatment and care, as illegal and arbitrary."

Heard Sri T. Bal Reddy and Sri C. Raghu, learned counsel for the petitioner, learned Government Pleader for Home for respondent Nos.1 to 3 and Sri S. Vinay Shankar, learned counsel for respondent No.4. In pursuance of the orders of this Court, dated 21-04-2015 the Advocate Commissioner appointed by this Court submitted a report executing the warrant as directed by this Court. It is reported by the learned counsel for the petitioner, learned Government Pleader for Home for respondent Nos.1 to 3 and learned counsel for respondent No.4 herein that the father of the petitioner viz., Major Thota Venkateshwara Rao (Retired) is discharged by the 4th respondent herein. It is also submitted that the petitioner herein has cleared all the dues payable to the 4th respondent. It is also brought to the notice of this Court that the 4th respondent herein has transmitted the caution deposit of Rs.50,000/- (Rupees fifth thousand only) to the account of Major Thota Venkateshwara Rao (Retired). In view of the above, the writ petition is closed. There shall be no order as to costs.

The Miscellaneous Petitions, if any, pending in this Writ Petition shall stand closed.
