THE HON'BLE SRI JUSTICE P.NAVEEN RAO CONTEMPT CASE No.111 of 2018 ORDER:
Heard.
2. WP (TR) No.20 of 2017 was allowed by this Court vide order dated 24.07.2017. The operative portion of the said order contains three directions viz., (1) to regularize the services of the petitioner in class-IV post on completion of five years of service or from 25.11.1993 whichever is later; (2) to grant retirement benefits by treating the service from the date of regularization as regular and work out the retirement benefits including pension payable to the petitioner; and (3) to make payment of arrears of amount consequent to the regularization from the date of institution of O.A.No.6773 of 2011. Alleging willful disobedience of the said order, present Contempt is filed.
3. Along with the affidavit deposed by Ms.R.A.S.P. Latha, 4th respondent herein, a copy of orders of Government in G.O.Rt.No.715 dated 04.10.2018 is filed, which discloses that the services of the petitioner were authorized to be regularized from 25.11.1993, so also grant of retirement benefits. Further, on attaining the age of superannuation, the petitioner was allowed to retire. She was paid the pensionary benefits duly counting the past service. Petitioner was also paid other amounts payable to her in accordance with the directions issued by this Court.
4. Thus, there is compliance of the directions issued by this Court. Therefore, there is nothing to keep the Contempt
Case pending. The Contempt Case is accordingly closed. However, if the petitioner is of the opinion that she is entitled to receive some more amounts, it is always open to her to calculate the amounts payable to her and make a representation to the authorities concerned. This order does not come in the way of petitioner in setting up any such claim.
Miscellaneous Petitions pending in this contempt case, if any, shall stand closed. There shall be no order as to costs. _____________________ P.NAVEEN RAO, J 29th March, 2019.
