HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.23464 of 2017 ORDER:

This writ petition is filed under Article 226 of the Constitution of India seeking to direct the respondents not to interfere with the land of the petitioners or not to dispossess them from their land, without following the due process of law.

It is the case of the petitioners that they are the owners of the agricultural land admeasuring Ac.1.20 guntas situated in Sy.Nos.80, 81 and 82AA of Upparapalli Village, Rajender Nagar Division, and they constructed a compound wall around the said land and that out of the above said land, they sold an extent of 1953 sq. yards and laid a private road in between the land sold and their remaining land. While so, at the instance of local political leaders, the respondents proposed to lay a road through the lands of the petitioners and they are trying to demolish the compound wall, without following the due process of law for acquiring the land. Aggrieved by the said action of the respondents, the petitioners filed this writ petition.

Heard and perused the material available on record. The main grievance of the petitioners is that the respondents are trying to interfere with their land and to dispossess them, without following the due process of law.

Considering the circumstances of the case and the grievance of the petitioners, this Court is inclined to pass the following order: " The respondents are directed to follow the due process of law, if they intend to acquire the land of the petitioners."

Accordingly, the Writ Petition is disposed of. No costs. Consequently, miscellaneous petitions pending, if any, shall stand closed.
