It is the case of the petitioner he is now working as Assistant Executive Engineer and eligible for post of Deputy Executive Engineer and as no promotions are made, the petitioner made representation for consideration to promote him or keep him as in-charge Deputy Executive Engineer. As no orders are passed, the present writ petition is filed.

Heard learned counsel for the petitioner.

Learned counsel for respondents 2 and 3, who submits that there are Assistant Executive Engineers above the petitioner and also no positive direction can be issued for promoting the petitioner.

It is to be seen that this Court cannot issue any mandamus directing the respondents to promote the petitioner. As and when the respondents take any decision for promoting or want to make any in-charge arrangements, it goes without saying that the respondentauthorities are obligated to consider the case of seniors in the cadre of Assistant Executive Engineers either to promotion or to be kept as in-charge. In the same manner, as and when decision is taken, case of the petitioner also be considered along with other candidates

in accordance with rules, if he is in the zone of consideration.
