THE HON'BLE SRI JUSTICE NOOTY RAMAMOHANA RAO CRIMINAL PETITION No.356 of 2013 ORDER:

None appears for the petitioner and there is also no representation, when her name is called out.

The petitioner herein/accused No.4 filed this petition for quashing the proceedings in crime No.16 of 2013 on the file of Kushaiguda Police Station, Cyberabad, registered for the offence under Section 498-A IPC and Sections 3 and 4 of Dowry Prohibition Act. The 2nd respondent herein was the de-facto complainant. It is set out in the complaint dated 07.01.2013 that her marriage with one Sri Prabhu Chaitanya Vadlapudi, was performed on 05.05.2011 at Ashish Garden Tarbund, Secunderabad. It is alleged that when she joined the matrimonial house at Nacharam, her parentsin-law and sisters-in-law were not allowing her to go out with her husband and were not allowing her to speak to her parents.

It is alleged by her that the petitioner herein, who is the sister-in-law of the complainant, deserted her husband and started torturing the petitioner and instigated her husband to beat her and harass her. It was also stated in the complaint that her husband got a job in TCS at Noida and hence, to join the said job, he left Hyderabad on 02.08.2011, but never picked up the calls made by her. While at the same time, he was speaking to on day-to-day basis with his parents. During the absence of her husband, she was living with her parents-in-law at her matrimonial home and during the said period, there is consistent and persistent demand from the sister-in-law to get additional dowry of Rs.10,00,000/-. Till the complaint is made on 07.01.2013, the husband of the complainant, not come to pick her up and take her to Delhi.

Taking advantage of the absence of her husband, her parents-in-law and sister-in-law, who is the petitioner herein, have harassed her mentally and physically.

Since the complaint made out a prima facie case, I do not consider that there is any warrant for quashing the said complaint. Accordingly, this criminal petition is dismissed. Consequently, miscellaneous petitions, if any pending shall also stand dismissed.
