SMT JUSTICE T.RAJANI CRIMINAL PETITON No.105 OF 2018 ORDER:

This petition is filed seeking for grant of anticipatory bail to the petitioner, who is A2, in Crime No.21 of 2017 on the file of Tanakal Police Station, Ananthapuramu District. The offences alleged are under Section 286 IPC, Section 9-B(b) of Explosives Act and Section 5 of Explosive Substances Act, 1908.

Heard the counsel for the petitioner and the Public Prosecutor appearing for the respondent.

As per the case of the prosecution, this petitioner was supplying Gelatin sticks and other material to A1 and the fact came to light on the confession of A1. The counsel for the petitioner submits that except the confession statement of A1, which is not admissible, there is no other material. But, the public prosecutor submits that statements of the witnesses were recorded and the witnesses also spoke about the complicity of the accused and that call records of the phone of this petitioner were also sought to be obtained. 4.

Hence, in view of the above allegations, this court opines that this is not a fit case for granting anticipatory bail.

Accordingly, the Criminal Petition is dismissed.

However, the petitioner can file a petition seeking for regular bail by surrendering himself before the court below. The court below shall dispose of the bail application, if any filed, expeditiously, preferably on the same day, subject to the pressure of other work.
