THE HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.8294 OF 2016 ORDER:

This Criminal Petition is preferred by the petitioners/A-1 to A-21 under Section 482 Cr.P.C. seeking to modify the order, dated 16.5.2016, in Crl.M.P.No.1025 of 2016 in Crime No.22 of 2016 on the file of the Special Sessions Judge - cum - IV Additional Sessions Judge, Tirupathi insofar as execution of the sureties from the local limits of Chittoor District is concerned.

2. Learned counsel for the petitioners has submitted that even though bail was granted to the petitioners on 16.5.2016, the petitioners could not secure sureties from Chittoor District since they are the native of Krishna District; that the petitioners are ready to produce the sureties from their native district i.e., Krishna District and hence, prays to relax the said condition.

3. Considering the facts and circumstances of the case and in view of the fact that the petitioners are imprisoned for a long period, the condition imposed on the petitioners in the order, dated 16.5.2016, in Crl.M.P.No.1025 of 2016 in Crime No.22 of 2016 on the file of the Special Sessions Judge - cum - IV Additional Sessions Judge, Tirupathi insofar as execution of the sureties from the local limits of Chittoor District is concerned is hereby relaxed. The said condition is modified as under:

"The petitioners/A-1 to A-21 shall be released on bail on their executing a bond for Rs.25,000/- (Rupees Twenty Five Thousand only) each with two sureties each from the local limits of Krishna District for the like sum to the satisfaction of Additional Judicial Magistrate of First Class, Srikalahasti."

4. With the above modification, the Criminal Petition is allowed.

5. Miscellaneous petitions pending, if any, in this Criminal Petition shall stand closed.
