ORDER: (Per the Hon'ble the Chief Justice Sri Raghvendra Singh Chauhan) The petitioner, Punem Laxmi, has filed the present Habeas Corpus Writ Petition, ostensibly, on the ground that her daughter, Punem Bhavani, has been kidnapped by one Mr. Bhuwaneswar Kumar, and is being illegally detained by him. Today, the Commissioner of Police, the respondent No.2, has produced Punem Bhavani before this Court. This Court has spoken to Punem Bhavani. She informs this Court that she is twenty years old young lady. She further claims that she has completed her Nurse Training Course. According to her, she and Mr. Bhuwaneswar Kumar got married. She is presently living with Mr. Bhuwaneswar Kumar and her in-laws. According to her, she is happily married and happily living with her husband and in-laws. She further informs this Court she has no desire to reunite with her parents, who have not accepted her marriage with Mr. Bhuwaneswar Kumar. Therefore, she wishes to go back to her matrimonial home.
Mr. Variyala Chudamani Reddy, the learned counsel for the petitioner, has vehemently contended that Punem Bhavani is under fear. Therefore, she has made the said statement before this Court.
However, this Court does not find any sense of fear in the deposition given by Punem Bhavani before this Court. Since Punem Bhavani happens to be a major, since her desire is to go back to her matrimonial home, this Court directs the respondent No.2 to restore her custody to Mr. Bhuwaneswar Kumar.
With these directions, the Writ Petition stands disposed of. There shall be no order as to costs.
The miscellaneous petitions pending, if any, shall stand closed.
