Aggrieved by the occupancy rights certificate granted by the Revenue Divisional Officer, Malkajgiri in File No.I/7480/2012 dated, petitioner preferred an appeal, being Appeal No.F1/1794/2014, before the second respondent. In the said appeal, petitioner has filed an interim application seeking suspension of the said occupancy rights certificate. The grievance of the petitioner in the present writ petition is that the second respondent is not taking up and passing appropriate orders in the interlocutory application, referred to above.
2. Heard learned Government Pleader.
3. The claim with respect to occupancy rights certificate granted to a private party respondent by the RDO is questioned by the petitioner in the appeal before the second respondent. The appeal is already pending from July 2014 and by now, notices must have been served on the parties concerned. Hence, instead of directing the second to decide the interlocutory application, it is appropriate that the second respondent is directed to fix an early date for hearing of the appeal itself and hear and decide the said appeal expeditiously, preferably, before end of December 2015.
The writ petition is disposed of. As a sequel, the miscellaneous applications, if any,
