O R D E R
The grievance of the petitioner in this case was that the police were not providing protection to her property which was covered by the decree passed in her favour by the learned III Additional Junior Civil Judge, Guntur, in O.S.No.1364 of 1994.
Sri P.R.Prasad, learned counsel for the petitioner, states that the police authorities had earlier provided protection pursuant to the order dated 30.08.2010 passed by the learned III Additional Junior Civil Judge, Guntur, in E.A.No.439 of 2008 in E.P.No.774 of 2008 in O.S.No.1364 of 1994. However, he fairly concedes that the execution petition was closed thereafter and the said order, which was passed at the interlocutory stage in the execution proceedings, was no longer in operation. In that view of the matter, this Court finds no illegality in the police authorities not acting upon the mere request of the petitioner to provide her police aid. It is for the petitioner to obtain necessary orders from the competent Court of law and only thereafter, the police would be under a duty to comply therewith.
Reserving liberty to the petitioner to seek recourse to appropriate remedies in accordance with law, the writ petition is dismissed. Pending miscellaneous petitions, if any, shall also stand dismissed. No order as to costs.
