THE HON'BLE SMT. JUSTICE KONGARA VIJAYA LAKSHMI WRIT PETITION No.18557 of 2013 ORDER:

This writ petition is filed to declare the action of the respondent in sealing the flour mill premises of the petitioner on 21.6.2013, as null and void. The case of the petitioner is that the petitioner is running a flour mill and has the license to run the same; on 21.6.2013, the checking Inspector done a surprise check of the business premises of the petitioner on the allegation that the petitioner is having PDS rice and he seized 6.50 quintals of rice. Counter affidavit has been filed by the respondent no.1 stating inter alia that at the time of surprise visit of the business premises of the petitioner, the officials found and seized 6.50 quintals of Public Distribution System rice. Basing on the instructions of Civil Supplies Department, the respondent‐ Corporation seized the business premises.

Thereafter, the petitioner preferred the present writ petition. In pursuance of the orders issued by the Assistant Supply Officer vide letter No.ASO/30/2013, dated 6.8.2013, the respondent‐Corporation removed the seal of the petitioner flour mill. As the counter affidavit says that the seal of the petitioner's flour mill is removed pursuant to the letter of the Assistant Supply Officer, dated 6.8.2013, no further orders are necessary in the writ petition. The Writ Petition is closed accordingly. No order as to costs.
