THE HON'BLE SRI JUSTICE A.V.SESHA SAI WRIT PETITION Nos.28145, 28146, 28148, 28156 and 28157 of 2017 COMMON ORDER:

Heard learned counsel for the petitioners, Sri Laxminarayana Alisetty for National Highways Authority and Sri N.Praveen Kumar for the 3rd respondent Municipality.

Since the petitioners in these cases share a similar grievance, this Court deems it appropriate to dispose of these writ petitions by way of this common order.

When the matters are called, learned Government Pleader for Roads and Buildings placed on record the written instructions issued by the Deputy Executive Engineer (R&B), Nirmal. Operative portion of the said instructions reads as under: "The existing available land given by the (R&B) Department is 100 feet, whereas the land width of the above road is length is 132 feet by the Assistant Director, Survey and Land Records, Nirmal vide Lr.No.CA/287/2017, dated 08.08.2017, our department is executing the work within available land. No private land will be taken in the above work. If any structures or buildings of private land found in the road boundary of the above stretch, by following due process of law, the encroachments will be removed as per law."

Reiterating the above instructions, it is submitted by the learned Government Pleader that the respondents shall follow due process of law.

Recording the said submission and placing on record the above instructions, these writ petitions are disposed of. Miscellaneous petitions, if any, shall also stand disposed of. There shall be no order as to costs.
