THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO CONTEMPT CASE No.1280 of 2015 ORDER:

This Contempt Case is filed alleging non implementation of order, dated 17.07.2014, in W.P.No.18607 of 2010. This Court passed a detailed order in the aforesaid Writ Petition and operative portion thereof reads as follows: "In the circumstances, this writ petition is disposed of directing the first respondent to inspect the premises owned by the petitioner once again and if there is any necessity to issue a supplementary notice after noticing the constructions, it may be issued to the petitioner in addition to the notice issued on 30.07.2010 and the petitioner is given liberty to submit his explanation within 30 (thirty) days from the date of receipt of such notice by the first respondent. If the first respondent does not feel that no further notice is required in view of the notice issued on 30.07.2010, he will be at liberty to take further action in accordance with law."

2. Respondents 2 and 3 filed counter stating that pursuant to the order of this Court inspection was conducted on 14.10.2014 and notice was issued on 16.10.2014. But, in view of amended Act 15 of 2013, 100% of property tax was imposed as penalty.

3. Respondent No.4 filed counter stating that Government issued G.O.Ms.No.128, dated 25.02.2015 and he submitted application for regularization of third floor. Pursuant to his application, 100% of property tax was imposed as penalty pending consideration of regularization of third floor.

4. In view of the above actions taken by the respondents, it cannot be held that the order of this Court was violated.
