HON'BLE SRI JUSTICE SURESH KUMAR KAIT Writ Petition No.24751 of 2016 ORDER:
Vide present writ petition, the petitioners seek writ of Mandamus, declaring the inaction of the respondents in completing the land acquisition proceedings initiated by issuing Section 4(1) Notification dated 25.06.2013 for the land of the petitioners, which was acquired for the purpose of Dummagudem Project, renamed as Sita Rama Lift Irrigation Scheme, Paloncha and not releasing the compensation on the basis of New Act i.e., Act No.30/2013, as illegal
2. Heard both sides. Learned Assistant Government Pleader for Respondents 1, 3 and 4 submits that the Project in question was earlier named as 'Rajiv Dummagudem Project' during combined State of Andhra Pradesh. After bifurcation of the State, the Telangana Government changed the name of the said project as 'Sita Rama Lift Irrigation Project'. He further submits that as most of the project area was in the State of Andhra Pradesh, the Telangana Government had decided to change the alignment of the project. He assured this court that if the lands of the petitioners are acquired, the petitioners would be put to the notice and accordingly, compensation would be paid.
3. Keeping in view of the submissions made by the learned Assistant Government Pleader, I hereby direct the respondents not to dispossess the petitioners without due process of law.
4. In view of the above direction, the writ petition is disposed of. No order as to costs. Pending miscellaneous petitions, if any, in this writ petition shall stand closed.
