THE HON'BLE SRI JUSTICE RAJA ELANGO CRL.P.M.P.No.7420 OF 2015 AND CRIMINAL PETITION No.14771 OF 2013 ORDER:
This criminal petition under Section 482 of the Code of Criminal Procedure is filed by the petitioners/A.2 and A.3 seeking to quash the proceedings in crime No.289 of 2013 of Humanyun Nagar Police Station, Hyderabad, registered for the offences under Sections 406, 506 read with Section 34 IPC.
The brief facts of the case are as follows. The marriage of the complainant and A.1 was performed and at the time of marriage, the parents of the complainant gave Rs.10 lakhs as dowry and after few days, A.1 along with her parents, A.2 and A.3, started harassing the complainant for additional dowry. A.1 used to come to house in drunken condition and tortured the complainant physically and mentally. Hence, the complaint.
Heard and perused the material available on record. When the case is taken up for hearing, learned counsel for the petitioners submits that the proceedings against A.1 in crime No.289 of 2013 is quashed by the other Bench of this Court. Learned counsel for the petitioners as well as counsel for de facto complainant/second respondent submit that they have filed Crl.P.M.P.No.7420 of 2015 seeking permission of this Court to compound the offences and consequently, to quash the proceedings. Along with the said application, they have filed Memorandum of Understanding stating that they agreed to dissolve their marriage by customary procedure of pronouncement of talaq and that A.1 agreed to pay an amount of Rs.18 lakhs towards full and final settlement of claims of the de facto complainant and to that extent A.1 has given the Demand Drafts also, and that the same is signed by both the parties. The said Memorandum of Understanding forms part of record.
Considering the above, the petitioners and second respondent/de facto complainant are permitted to compound the offence. In view of the amicable settlement of the dispute between the parties, Crl.P.M.P.No.7420 of 2015 is ordered and the compromise is recorded. Consequent thereto, the criminal petition is allowed and the proceedings against A.2 and A.3 in crime No.289 of 2013 of Humayun Nagar Police Station, is hereby quashed.
The Criminal Petition is accordingly allowed. Consequently, miscellaneous petitions, if any, pending, shall stand closed. _____________________ JUSTICE RAJA ELANGO 30.07.2015 pln
