THE HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.17882 of 2017 ORDER:

This writ petition is filed by the petitioner, under Article 226 of the Constitution of India, seeking to declare the action of the respondents not issuing "Trade license" for operating of Mineral water plant, situated at D.No.62-7-51, Jawaharnagar, Sriharipuram, Visakhapatnam District, as illegal, arbitrary, unconstitutional and violative of principles of natural justice and contrary to Articles 14 and 19(1)(g) of Constitution of India and consequently, direct the respondents to issue Trade License for operating of Mineral water plant, situated at D.No.62-7-51, Jawaharnagar, Sriharipuram, Visakhapatnam District of the petitioner.

Heard the learned counsel for petitioner, learned Government Pleader for Municipal Administration & Urban Development for the 1st respondent and Sri S.L.N. Reddy, learned Standing Counsel for respondents 2 & 3 and with their consent, the writ petition is taken up for disposal at the stage of admission. 3.

The case of the petitioner is that the petitioner applied D.D.No.634853, dated 02.02.2017, drawn in favour of the Commissioner, Greater Visakhapatnam Municipal Corporation, and the said D.D. was also sent through Speed Post on 03.02.2017. It is further case of the petitioner that the petitioner submitted representations, dated 02.02.2017 & 04.02.2017, to respondents 2 & 3 to issue trade license to his R.O. Plant, but the

RE,J W.P.No.17882 of 2017 same are pending till date even though the petitioner paid necessary fee for issuing trade license.

When the matter is taken up, both the learned counsel agreed for disposal of the writ petition with a direction to respondents 2 & 3 to expeditiously dispose of the representations of the petitioner.

Having regard to the same, without expressing any opinion on the merits of the matter, the Writ Petition is disposed of directing respondents 2 & 3 to consider the representations of the petitioner, dated 02.02.2017 & 04.02.2017, pass appropriate orders, as warranted by law, as expeditiously as possible, preferably within a period of eight (8) weeks from the date of receipt of a copy of this order and communicate the decision to the petitioners.
