This writ petition is filed seeking to declare the action of the third respondent herein in detaining the petitioner's Eicher Pro Van bearing Registration No.TS 07 UH 2090, on 14.12.2019, on the ground that the driver of the vehicle was drunk, as being illegal, arbitrary and unjust. 2.
Heard the learned counsel for the petitioner and the learned Assistant Government Pleader for Home.

Learned Assistant Government Pleader for Home submits that the vehicle has been seized, since the driver was found drunk and such act being in violation of the provisions of the Motor Vehicles Act, a case has been registered by the authorities.

Since it is stated that a case is already registered, the petitioner is at liberty to approach the concerned authority/Court and make necessary application by seeking release of the vehicle. Upon approaching the concerned authority/Court where a case is already registered by way of filing application, the same shall be considered by the authority/Court, in accordance with law.

With the direction as above, the writ petition is disposed of. Pending miscellaneous petitions, if any, shall stand closed in the light of this final order. No order as to costs.
