THE HONOURABLE SRI JUSTICE RAJA ELANGO TRANSFER CRIMINAL PETITION No.188 OF 2014 ORDER:

This petition is filed by the petitioner-accused under Section 407 Cr.P.C. seeking to transfer C.C.No.131 of 2009 pending on the file of the I Additional Judicial First Class Magistrate, Proddatur, Kadapa District, to any other competent Court at Hyderabad. Heard and perused the material available on record. The petitioner is alleged to have committed the offence punishable under Section 138 of the Negotiable Instruments Act. The grounds raised by the petitioner in the affidavit filed in support of the petition are not convincing and therefore, this Court is not inclined to grant the relief sought by the petitioner. At this stage, the learned Counsel for the petitioner has sought for dispensing with the presence of the petitioner before the trial Court. In view of the above submission, the presence of the petitioner before the trial Court is dispensed with except on the dates when his presence is specifically required by the trial Court. The petitioner is directed to be represented through his Counsel before the trial Court on all hearing dates.

Accordingly, the Transfer Criminal Petition is disposed of. Consequently, miscellaneous petitions pending, if any, shall stand closed.
