HON'BLE Dr. JUSTICE B. SIVA SANKARA RAO CRIMINAL PETITION No.6463 of 2015 ORDER :

This Criminal Petition is filed by the Petitioner/Accused No.1 under Section 482 Cr.P.C seeking to quash the proceedings in C.C. No.229 of 2014 on the file of the XIII Additional Chief Metropolitan Magistrate (Mahila Court) at Hyderabad registered for the offence punishable under Section 498-A I.P.C and Sections 3 and 4 of the Dowry Prohibition Act against the petitioner/A-1 among other three accused including his parents.

2) Heard the learned counsel for the petitioners and the 2nd respondent-State represented by the Public Prosecutor before admission and before ordering notice to the 1st respondent and perused the material on record.

3) As the facts fall short for this Court to admit the application for quashing the proceedings supra under Section 482 Cr.P.C, the petition is disposed of giving liberty to the petitioner, who is admittedly enlarged on anticipatory bail, if at all settled as employee in Ireland unable to attend the day-to-day trial, to file an application under Section 205 Cr.P.C before the learned Magistrate with notice to the A.P.P concerned, the learned Magistrate after hearing, permit including to examine the accused on

framing of charges, if any, under Section 240 Cr.P.C through advocate, special vakalat holder, but for personal appearance during the examination under Section 313 Cr.P.C and defence evidence if any.

4) With the above observations, this criminal petition is disposed of. As a sequel, miscellaneous petitions pending, if any, in this criminal petition shall stand closed. __________________________ Dr. B. SIVA SANKARA RAO, J 22.07.2015 ksh
