HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITON No.4315 of 2017 ORDER:

This writ petition is filed to declare the action of the 3rd respondent in issuing letter dated 07-12-2016 refusing to receive and registering the document in respect of subject land.

Heard the learned Assistant Government Pleader for Revenue.

Learned counsel for the petitioners submits that several transactions took place in respect of subject land since 1997 onwards. Even then, 3rd respondent- Sub-Registrar is refusing to register the document filed in respect of the subject land. Though the petitioners challenge the impugned letter, it is brought to the notice of this Court that he is not a party to the same. The impugned letter is issued in the name of one K.V.Subbaiah. Since the petitioners are not parties to the impugned letter, this Court will not go into that aspect and no relief can be granted against that letter. As on today, the petitioners have not approached for registration of the document and the petitioners want to present any document for registration, they can approach the 3rd respondent and on such approaching, the 3rd respondent shall receive the same and if he wants to refuse to register the same, he is obligated to record reasons under Section 71 of the Registration Act (for short "the Act"). Otherwise, register the same, if the said property is not in prohibitory list under Section 22-A of the Act

and the same is in order as per provisions of order as per provisions of Indian Stamp Act and Registration Act and the rules made thereunder.

With the above direction, the writ petition is disposed of. As a sequel to the disposal of this petition, miscellaneous petitions, if any, pending shall stand closed. _________________________ A.RAJASHEKER REDDY,J 09-02-2016 Nvl
