HON'BLE SRI JUSTICE S.V.BHATT WRIT PETITION No.566 of 2018 ORDER:

Heard Ms.Farhat Firdous for petitioners and the Assistant Government Pleader (Home) for respondents.

The petitioners pray for the following relief :- " ..... to issue an appropriate writ, order or direction more particularly one in the nature of Writ of Mandamus declaring the action of the 3rd respondent in neither investigating FIR No.129/ 2017, 130 of 2017, 154 of 2017 to 159 of 2017, 164 of 2017, 165 of 2017 and 309 of 2017, not arresting the accused, in the said case pursuant to the Complaint filed by the petitioner, before them against the 4th to 16th respondent and his cohorts as illegal....." . Briefly stated, the petitioners are aggrieved by the inaction of respondents in investigating or filing charge-sheets in the FIRs, referred to above.

The Assistant Government Pleader, places on record, written instructions dated 04.01.2017 received from the SubInspector of Police, Chandrayangutta Police Station/ 3rd respondent. The operative portion of the instructions reads thus :- Sl.No.

165/ 2017 574/ 2017 " In Cr.No.309 of 2017, examined the (3) witnesses, arrested the (3) respondents and (3) respondents have been absconding since the FIR, and also have to examine the some more witnesses, have to arrest remaining respondents, after the completion of investigation will file charge-sheet before the honourable court in this case." .

From the above, it is clear that charge-sheets are filed as many as in ten cases and in Cr.No.309 of 2017, investigating is substantially completed and in due course, charge-sheet will also be filed.

In view of the above instructions, the writ petition is disposed of. Further, the 3rd respondent considers completing the investigation and filing charge-sheet in Cr.No.309 of 2017 as well, within four weeks from today.

Miscellaneous petitions, if any, pending, shall stand closed. No order as to costs.
