HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.6593 of 2015 ORDER:

This petition is filed by the petitioner-A4 under Section 438 of Criminal Procedure Code seeking to grant bail to him in Crime No.84 of 2014 of Dumbriguda Police Station, registered for the offence punishable under Sections 302 and 109 r/w 34 IPC. Heard and perused the material available on record. It is alleged that while the mother of the de facto complainant was grazing the cattle in his fields in his native village of Dondavalasa, she was killed by two persons at the instance of A1 and his associates on the ground that the deceased was practicing witchcraft against the mother of A1.

Learned Counsel for the petitioner submitted that there is no prima facie against the petitioner and even though the de facto complainant did not give the name of the petitioner, the name of the petitioner was found place in the FIR.

Considering the facts and circumstances of the case, this Court feels that it is not a fit case to grant anticipatory bail to the petitioner. Accordingly, this Criminal Petition is dismissed. _______________ RAJA ELANGO, J 23rd July 2015 Nn
