THE HON'BLE SRI JUSTICE A. RAJASHEKER REDDY WRIT PETITION No.20910 OF 2016 ORDER:

This Writ Petition is filed seeking to declare the action of respondent Nos.3 and 4 in not considering the representation, dated 20.05.2016, of the petitioner, as illegal and arbitrary.

The case of the petitioner is that her grandfather late Kannaiah was the owner of the lands admeasuring Ac.023 cents, Ac.1-60 cents, Ac.0-20 cents, Ac.0-35 cents, AC.2-23 cents, Ac.0-40 cents, Ac.3-55 cents, Ac.4-43 cents, Ac.0-35 cents, Ac.2-00, Ac.3-12 cents, Ac.1-92 cents and Ac.1-68 cents covered by Survey Nos.61/6, 61/7, 61/8, 63/6, 70/8, 70/9, 76/1, 84/1, 93/1, 73/2, 59/5, 104/2 and 104/3, respectively, situated at Narsingpet Village, Kunavaram Mandal, East Godavari District, and died intestate leaving behind the aforesaid properties to respondent No.5 as well as to her. As the subject lands were coming under submergence of Polavaram Irrigation Project, respondent No.3 issued notification for acquisition of the subject lands publishing the name of respondent No.5 as pattadar and possessor of the subject lands, as the subject lands are the ancestral properties inherited from his father, who is her grandfather. Therefore, she made an application on 20.05.2016 stating that she is entitled to share in the compensation, but

respondent No.4, without issuing any notice to her, is taking steps for conducting enquiry. Aggrieved by the same, the present Writ Petition is filed.

Heard learned counsel for the petitioner and the learned Assistant Government Pleader for Land Acquisition.

Learned Assistant Government Pleader for Land Acquisition submits that no application is received from the petitioner.

In view of the above facts and circumstances of the case, it is open for the petitioner to make a fresh application to respondent No.4 within a period of ten (10) days from today and on receiving such application, respondent No.4 shall consider the same and take appropriate action in accordance with law, after issuing notice to the petitioner and the affected parties. With the above direction, the Writ Petition is disposed of. Miscellaneous Petitions, if any, pending in this Writ Petition, shall stand closed. No costs. __________________________ A.
